I think in cases where there is ample evidence the death penalty should be there. After reading a bit more on this case I think it was met:

But the fact remains that there was no physical evidence. Two witnesses, who might have mistaken him for someone else should not be enough to kill him. |

Okay I should start by saying while I have several big problems with the death penalty as it is, there are times I would love to see it used. And here's why.
About a week and a half ago two convenience store were robbed about an hour drive away from each other in Iowa. Both robberies were committed by the same 17 year old. Micheal Swanson, who is being tried as an adult, though why he is being tried makes no sense as he has plead guilty. In both robberies he demanded cash and cigarettes which the cashiers quickly handed over without any hesitation, and in both cases he shot and killed the cashiers. He apparently didn't want them to be able to spot him in a line up not even thinking about the cameras.
When he was caught a few hours later returning to his home in Minnesota he seemed to find it funny. When he was booked and led to prison a reporter asked "What's so funny, you're smiling?" Micheal Swanson replied, and I quote "Y'all are funny." with a laugh.

You're entitled to that opinion. Personally, I'd love to see that waste of flesh spend the rest of his hopefully extremely long life in a 9 foot by 6 foot room with no privacy due to a door made from bars, twenty minutes of fresh air every day walking in a circle with his head bowed in a fully enclosed yard, no access to cigarettes, TV or movies, and a basic diet fulfilling his physical needs.
I'd love to see him when he's 80 years old, to see if he's still grinning or if he, in my opinion far more likely, is crumbling and begging to be let out to die in freedom.
And, to quote the Watchmen-character Rorschach, with whom I otherwise agree on very, very few things, I would look down on him and say: "No."
Then once his sorry remains had passed this mortal coil, his corpse would be sent to the prison incinerator, where it would serve his only useful purpose by supplying the other inmates with roughly ninety seconds of heat as it fueled the fires.
THAT is a punishment. Killing him isn't. |

Witnesses are incredibly bad evidence.
If you stage a mock bankrobbery or something, then interview all the witnesses afterwards, you'll find that very few can agree to what the robber looks like. And in a proper lineup, I'd expect no better than 75% correct identifications.
The testimony is 'hearsay' and worth even less.
The only problem with 'life term' sentences is that the rest of the community that has to foot the bill for him; buildings, guards, food, clothing. Personally, I think long-term sentences should include the words 'hard labour'. _________________ "My name's Lion, Anthony Lion"

Which increases the costs of the guards, food and clothing...
...maybe if one strips off the human rights part and add a Kzin hunting preserve...
(unfortunately, many things would be considered 'cruel and unusual'...) |

I don't care about the costs for guards, food and clothing. Guards, food and clothing requires people to be employed. Meaning less unemployment. And in any case, I am happy to pay my taxes. |

Never said that the work they'd be able to do would rduce the cost to the society. Just make them FEEL what a burden they are.
Besides, a lot of criminals never did a day of honest hard work in their life.
Come to think of it, a lot of younger offenders could use hard labour even on shorter terms. Might get them to wise up a bit.
'Community service'?

If I wasn't so attached to my home I'd simply move to somewhere sane, I hear Denmark is a beautiful place to live. Or if Aslaug gets the job she wants in Dublin I'd move to Ireland, so that I'd have at least one good friend in Europe. Actually Milady it's the attitude he displayed when he was arrested that he felt that he had not done anything wrong in his treatment of those dogs. I feel that he should spend the rest of his life working in a low wage job instead of making millions a year chasing an inflated pig's bladder. _________________ Beware of strong drink for it can make you shoot at tax collectors...
